Donald Trump suffered a major defeat at the U.S. Supreme Court. In a narrow 5-4 ruling, the justices decided that states may count mail-in ballots after Election Day — as long as they were postmarked on time. The Trump mail ballot defeat decision strikes at one of Trump’s top political priorities: reshaping America’s election system and severely restricting mail voting.
Trump has long claimed, without proof, that mail-in ballots enable mass fraud. He still argues that he was the real winner of the 2020 election against Joe Biden.
Mississippi Case At Center
The case centered on Mississippi. Under state law, mail-in ballots may be counted up to five days after Election Day if they were postmarked by Election Day. Similar systems already exist in more than a dozen states. After the Supreme Court ruling, they could gain even more legal protection.
For Trump, the ruling shuts down an important legal path in his war against mail voting.
Trump Mail Ballot Defeat: Barrett Delivers The Blow
What enraged Trump’s MAGA movement even more: the majority opinion was written by Justice Amy Coney Barrett, one of Trump’s own Supreme Court picks. Barrett, 54, was appointed by Trump during his first term and was celebrated at the time by conservatives as a major victory for the right.
Now some Trump loyalists see her as a traitor. Trump reacted angrily on Truth Social, calling the ruling a “tremendous loss.” He also claimed sarcastically that the decision now gives people more time to vote “illegally.”
Bannon Attacks Trump’s Own Justice
Steve Bannon, one of Trump’s most loyal allies, mocked Barrett after the ruling. He questioned whether conservatives had done proper “due diligence” before supporting her nomination.
Megyn Kelly also blasted Barrett, calling her a “turncoat” and accusing her of repeatedly siding with the left. For parts of the MAGA base, the ruling felt like betrayal from inside their own conservative Supreme Court.
Trump Pushes SAVE Act
Trump immediately used the defeat to push his stalled election bill, the so-called SAVE Act. The proposal would require stricter voter identification rules, proof of citizenship for registration and severe limits on mail voting.
Under Trump’s plan, mail ballots would be allowed only in exceptional cases, including illness, disability, military deployment or travel. But the bill remains stuck in the Senate, where Trump does not have the votes he needs.
Rhetoric Turns Apocalyptic
Trump’s language is growing increasingly extreme. After the ruling, he attacked Republican holdouts by name and demanded that his party fall in line.
He also warned of a “powerful Communist Movement” in the United States — one he described as more dangerous than World War I, World War II, Pearl Harbor or the September 11 terror attacks. The comparison shocked critics but fit Trump’s escalating rhetoric around elections.
The Mail Ballot Irony
There is also an awkward irony in Trump’s crusade. Despite his attacks on mail voting, Trump himself recently voted by mail in a Florida special election. That is the state where he has made Mar-a-Lago his main residence.
